Monthly members are required to give 30 days’ written notice. Membership ends on the final day of the month in which notice expires.
Annual members who cancel mid-term will receive a refund for unused whole months, less one month’s fee as an administration charge.
If you purchase your membership at a distance, you have a statutory 14-day cooling-off period during which you may cancel for any reason and receive a full refund.
Refunds are processed within 14 business days to the original payment method.
We may terminate your membership immediately and without refund for serious or repeated breach of these terms.
4. Services
Membership includes concierge coordination, gym access, personal training, recovery services, health monitoring, nutrition guidance, and community events, as described on our website.
Services are arranged through vetted third-party providers. Availability may vary by location and circumstance.
We use reasonable endeavours to fulfil all requests promptly and to the standard described.
Unused sessions or credits do not roll over to the following month unless otherwise agreed in writing.
We may modify specific services provided the overall standard of the membership tier is maintained. We will give reasonable notice of material changes.
5. Partner Facilities
Partner facilities operate under their own rules and policies. Members must comply with all applicable rules when using partner facilities.
Flow State acts as an intermediary in arranging access to partner facilities. We are not the operator or owner of those facilities.
If a specific facility becomes unavailable, we will arrange access to an alternative facility of equivalent standard.
6. Personal Training and Recovery
Sessions cancelled with less than 24 hours’ notice, or missed without notice, are forfeited and will not be rescheduled.
Personal trainers and recovery service providers are independent contractors or third-party partners. They are not employees of Flow State.
A health screening may be required before your first session. You are responsible for disclosing any relevant health conditions.
7. Network and Events
Member events take place subject to availability and capacity.
Access to networking dinners requires 3 months of continuous membership. Access to the annual retreat requires 12 months of continuous membership.
Event-specific policies may apply. Flow State may cancel, reschedule, or modify events with reasonable notice.
Event attendance is personal. Guests may only attend with explicit invitation from Flow State.
8. Member Conduct
Members must maintain a standard of professionalism and courtesy toward other members, staff, and service providers at all times.
Members must comply with all rules of partner facilities during their use of those facilities.
Abusive, threatening, or discriminatory behaviour toward any person will result in immediate termination of membership without refund.
We reserve the right to investigate complaints and to suspend membership pending investigation.
9. Health and Safety
Physical activity carries inherent risks. You participate in all training and recovery activities at your own risk.
We strongly recommend consulting a physician before beginning or significantly changing your training programme.
You must disclose any health conditions, injuries, or medications relevant to your training or recovery. Failure to disclose may limit or exclude Flow State’s liability.
10. Membership Card
Your Obsidian card must be returned to Flow State within 14 days of membership termination.
Lending your card to another person or using it to grant access to non-members will result in immediate termination of membership.
Lost or stolen cards will be replaced at a cost of £25.
11. Service Guarantees
If we fail to arrange 90% or more of your confirmed sessions over any rolling three-month period, and that failure is directly attributable to Flow State, you may be entitled to a refund of up to three months’ fees. Claims must be submitted in writing within 30 days of the period in question.
Our concierge team aims to respond to all messages within 24 hours on business days. Automated credits for response failures are applied as described on our website.
Guarantees apply only where your account is in good standing and you are compliant with these terms.
12. Liability
Flow State is not liable for the acts, omissions, or negligence of third-party partner facilities or service providers.
We bear no responsibility for the loss of, or damage to, personal property at any partner facility.
Our total aggregate liability to you in connection with your membership is limited to the total fees paid by you in the 12 months preceding the event giving rise to the claim.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
We exclude all liability for indirect, consequential, or special losses.
13. Intellectual Property
All content, branding, programmes, methodologies, materials, and designs created or provided by Flow State remain our intellectual property.
Members may not reproduce, distribute, or use Flow State intellectual property for any commercial purpose without our written consent.
Membership grants no licence to use our trademarks or brand identity.
14. Privacy and Data
We process your personal data in accordance with our Privacy Policy.
By joining, you consent to us sharing necessary personal information with partner facilities for the purpose of arranging access and services.
We may use photographs or video taken at Flow State events for marketing purposes unless you notify us in writing that you object.
15. Confidentiality
Members must keep confidential all personal or commercially sensitive information about other members that comes to their attention through the Flow State network.
Member contact details and personal information may not be shared externally without the relevant member’s consent.
Deal flow, investment opportunities, or business introductions facilitated through the Flow State network are confidential and may not be shared outside the membership without consent.
16. Force Majeure
We are not liable for any failure or delay in performing our obligations where that failure results from circumstances beyond our reasonable control, including but not limited to acts of God, pandemic, civil unrest, or regulatory action.
If a force majeure event prevents us from delivering core services for 60 or more consecutive days, either party may cancel the membership with a pro-rata refund for the unused period.
We will notify members of any force majeure event as promptly as reasonably practicable.
17. Dispute Resolution
Complaints should be directed to concierge@joinflowstate.club. We will acknowledge within 5 business days and aim to resolve within 20 business days.
If a dispute cannot be resolved directly, both parties agree to attempt resolution through CEDR mediation before commencing litigation.
Nothing prevents either party from seeking urgent injunctive or other equitable relief through the courts.
18. General
These terms are governed by English and Welsh law. The English and Welsh courts have exclusive jurisdiction over any disputes.
We may amend these terms at any time. We will give you at least 30 days’ written notice of any material changes. Continued use of the membership after that period constitutes acceptance of the revised terms.
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force.
Our failure to enforce any provision of these terms does not constitute a waiver of our right to do so in future.
These terms, together with the Privacy Policy, constitute the entire agreement between you and Flow State in relation to your membership.
